Petitioner was working for the last 35 years at Mirzapur. An order of transfer was passed against him on 30.05.2018, which was challenged before this Court by filing Writ A No. 14571 of 2018, which has been dismissed on 09.07.2018. It is thereafter that petitioner has offered his joining and therefore, he has been assigned work at Babhni, Sonbhadra. This order is now under challenge again in this petition.
This Court cannot encourage filing of such successive petitions, particularly, when the petitioner had been stationed earlier at one place for nearly 35 years. Otherwise also, the petitioner holds a transferable post and transfer is an incident of service. Law is, otherwise, settled that except in case where rules are violated or allegations of mala fide are established, ordinarily, interference with an order of transfer is not warranted. The challenge laid to the order of transfer, therefore, fails.
The writ petition is, accordingly, dismissed.
