The petitioner claims that he is a passport holder since the year, 2008. However, a notice was issued to him on 10.4.2018 by the respondent no.2 calling upon him to submit a reply in respect of the some criminal cases which are said to be pending against him. A copy of the said report is annexed as Annexure 3 to the writ petition.
It is submitted that the petitioner has replied the show cause notice on 16.5.2018 wherein he has stated that no criminal case is pending against him.
We have heard learned Counsel for the petitioner and learned A.S.G.I. for the Union of India and respondent nos.2 and 3.
The only prayer has been made by the learned Counsel for the petitioner is that a direction be issued upon the respondent no.2 to consider his reply dated 16.5.2018 and pass the appropriate order.
With the consent of the parties, the petition is taken on board and is being disposed of in terms of the Rules of the Court.
Considering the facts and circumstances of the case, we are of the view that the ends of justice would be met by issuing a direction upon the respondent no.2, Regional Passport Officer Vipin Khand, Gomti Nagar, Lucknow to consider the reply dated 16.5.2018 submitted by the petitioner to the show cause notice, in accordance with law, expeditiously, preferably within a period of two months from the date of communication of the order.
We make it clear that we have not expressed our opinion on the merits of the case and the respondent no.2, Regional Passport Officer Vipin Khand, Gomti Nagar, Lucknow shall pass the order independently in accordance with law.
With the aforesaid direction, the petition stands disposed of.
There is no order as to costs.
