Heard Sri Vijai Kumar Tiwari, learned counsel for the revisionist, Sri Ved Prakash Mishra, learned counsel for the opposite party no.2 and learned A.G.A. for the State and perused the material placed on record.
This criminal revision has been filed for setting aside the judgement and order dated 3.2.2018 passed by Additional Sessions Judge,Court No.1, Bareilly in Sessions Trial No.345 of 2014 (State of Uttar Pradesh Versus Abdul Hasan and others) under Sections 498-A, 304-B I.P.C., P.S. Hafizganj, District Bareilly.
Learned counsel for the revisionist has assailed order dated 3.2.2018 passed by Additional Sessions Judge, Court No.1, Bareilly, whereby the application of the defence under Section 311 Cr.P.C. for recalling first informant for cross-examining him on certain points which have been left out by the earlier counsel, has been rejected.
I have perused the application and the order passed thereon. The trial judge has rightly observed that as to what questions have been left out by earlier counsel to be put to the witness have not been mentioned in the said application.
I find no illegality, irregularity or perversity in the order impugned warranting interference by this Court.
The criminal revision lacks merit and it is, accordingly, dismissed.
