By means of this writ petition, quashing of order dated 4.12.09 passed by Judge Small Causes Court in Misc. case no. 7/09 Smt. Geeta Shivhare Vs. Abdul Hamid has been sought for. By the impugned order, learned judge has set aside the exparte judgement and order dated 18.4.09 and directed to hear the matter on merit in P.A. case no. 66/09 allowing the application of the petitioner filed under section 27 of U.P. Act no. 13 of 1972.
Sri Ramendra Asthana learned counsel for the petitioner wants to bring on record order sheet indicating therein that serivce of notice was sufficient on respndent and the court below has erred in allowing the application.
In view of that , put up this matter on 13th January 2010 as fresh.
