The prayers in the writ petition are as given under:
“i. Issue a writ of mandamus or other appropriate writ, order or direction directing the respondent to allow the 1st petitioner to pay the balance interest amount 10 equal monthly installments.
ii. Issue a writ of Mandamus or other appropriate writ, order or direction directing the respondents to take a lenient view towards the petitioners by allowing them to continue the over draft facility granted as per loan A/C No. RCCRT 9007081620 as per agreement dated 28.06.2012.”
2. Heard the learned counsel for the petitioners, the learned counsel for the respondent Bank and the learned Government Pleader as well. The learned counsel for the respondent Bank submits that the account has become NPA on 05.08.2014 and that the tenure of the overdue facility is over.
The total dues in respect of 1st petitioner is about and that of the 2nd petitioner is ₹3,13,445/-
₹6,04,293/-
3. After hearing both the sides, the writ petition is disposed of, directing the petitioners to clear the entire liability by way of W.P.C. No. 25403 of 2014 -2-
'ten' equal monthly instalments, the first of which shall be effected on or before the 10th day of November, 2014; followed by similar instalments to be effected on or before the 10th of succeeding months. Subject to this, the coercive proceedings being pursued against the petitioners shall be kept in abeyance for the time being. It is made clear that, if any default is committed with regard to repayment of the liability as above, it will be open for the respondents to proceed against the petitioners for realization of the entire amount in a lump, from the stage where it stands now. The petitioners shall produce a copy of the judgment along with a copy of the writ petition before the concerned respondent for further steps.
