Heard the learned counsel for the appellants on the point of admission and perused the impugned judgment and order dated 23.12.2009 passed by the trial court.
This appeal has been filed by the accused-appellants, Abdul Hameed @ Guddu, Kamal, Akbar, Niyaz @ Banne, Azad @ Nanhey and Ram Milan against the judgment and order dated 23.12.2009 passed by Additional Sessions Judge/Fast Track Court No.1, Court No.10, Sultanpur in Sessions Trial No.181 of 2005 (Crime no.332 of 2004) State Vs. Mustaque and others, under Sections 307, 147, 148, 149, 324, 504, and 506 I.P.C., Police Station Peeparpur, District Sultanpur, whereby the learned Additional Sessions Judge has held the each of the accused-appellant guilty under Sections 147, 148, 307/149, 325/149, 504, 506(2) I.P.C. The learned Additional Sessions Judge has convicted and sentenced to each of the accused-appellant to undergo different terms of imprisonment and to pay fine with default stipulation. The maximum sentence awarded by the trial court is of seven years under Section 307/149 I.P.C.
