Heard Sri Zafar M. Naiyer, learned Senior Advocate, assisted by Sri Himanshu Kumar, learned counsel for the petitioner, Sri K.R. Singh, learned counsel appearing for respondent no.3, Sri Sekhar Pandey, learned counsel appearing for respondent no.2, learned Standing Counsel appearing for the State and perused the record.
The petitioner by means of this writ petition under Article 226 of the Constitution of India, has prayed for a relief of injunction qua action being undertaken at the end of the respondent no.3.
From the perusal of the entire writ petition and pleadings raised thereunder we are not able to trace out even a single letter or order in writing at the end of respondent no.3 by which it cannot be said that the petitioner's possession is under any threat. Even otherwise the respondents counsel submits that the petitioner has already invoked remedy under the U.P. Revenue Code for the purposes of correction in revenue entries relating to the land in question.
At this stage, learned Senior Advocate prays for withdrawal of the writ petition.
The writ petition is accordingly dismissed as withdrawn at this stage.
