Following orders were passed in the matter on 7.9.2018:-
"It is alleged that the petitioner was posted at Gautambudh Nagar in November, 2017 and has again been transferred in March, 2018. Against the order of transfer, petitioner has represented in the matter. It has been forwarded by the police Headquarter to the Additional Director General of Police, Meerut Zone. Submission is that no decision has yet been taken.
Learned Standing Counsel may obtain instructions in the matter. Put up in the additional cause list on 18.9.2018."
Learned Standing Counsel has obtained instructions, according to which, petitioner is a resident of Bulandshahar and in view of the govt. order dated 7.6.2014, he cannot be posted at any adjoining district of his home town. Since Gautam Budh Nagar is an adjoining district of Bulandshahar, therefore, petitioner has been transferred to Baghpat.
Reasons disclosed for petitioner's transfer in the facts and circumstances is not shown to be perverse or arbitrary. Petitioner otherwise holds a transferable post and transfer is an incidence of service.
Writ petition is, accordingly, dismissed.
