Heard Ms. Shaheen Ansari holding brief of Mohd. Akbar Shah Alam Khan, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This application u/s 482 Cr.P.C. has been filed seeking the direction to the Court below to decide the S.T. No.13/2021 (State Vs. Javed & others) arising out of Case Crime No.46 of 2020, under sections 363, 376, 504, 506 IPC & Section 3/4 POCSO Act, Police Station Budhana, District Muzaffar Nagar.
Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant.
In the facts and circumstances of the case the lower court concerned is directed to expedite and decide the aforesaid case expeditiously without granting any unnecessary adjournment to either of the parties, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case.
With the aforesaid observation, this application is disposed of finally.
