JUDGMENT / ORDER

Court No. - 49
Case :- WRIT - C No. - 27759 of 2019 Petitioner :- Abdul Bari Respondent :- State Of U.P. And Another Counsel for Petitioner :- Prabhakar Dubey Counsel for Respondent :- C.S.C.
Hon'ble Siddhartha Varma,J.
The contention of the petitioner is that since the order dated 12.10.2018 had been passed, the order dated 3.11.2018 which was passed on the basis of the inspection dated 18.9.2018 be not given effect to.
Learned Standing Counsel, however, submits that the inspection dated 18.9.2018 was independent of the inspection dated 4.10.2018 and, therefore, the petitioner cannot take any advantage of the order dated 12.10.2018.
What the learned Standing Counsel states is correct.
Under such circumstances, if the petitioner files an appeal within the next 15 days from today, the appeal itself shall be decided within a period of two months from the date of its filing without going into the question of limitation. If any Stay Application is filed, then order shall be passed on it within a week.
The writ petition is, accordingly, disposed of.
Order Date :- 22.8.2019 GS (Siddhartha Varma, J.)
