JUDGMENT / ORDER

The petitioner was given the permit to extract granite stone from the quarry situated in the 'puramboke' during the period from 30.5.2009 to 29.09.2009. According to the petitioner, only the directed quantity was extracted. But much later, the petitioner was served with Ext.P1 demand notice under the RR Act requiring to satisfy a total sum of ₹3,00,760/-. The said notice was issued without giving any opportunity of hearing to the petitioner as to the quantification of the amount if at all any payable by the petitioner. In the said circumstance, the petitioner approached the first respondent by filing Ext.P3 appeal, which is pending consideration. The petitioner is constrained to approach this Court because of the coercive steps being pursued by the respondents in the meanwhile.
2. Heard the learned Government Pleader as well.
3. Considering the facts and circumstances, there will be a direction to the 1st respondent to consider and pass final orders W.P.C. No. 30841 of 2014 -2-
on Ext.P3 appeal in accordance with law after hearing the petitioner, which shall be done at the earliest, at any rate, within 'three months' from the date of receipt of a copy of this judgment. Coercive proceedings by way of recovery shall be kept in abeyance till such time, subject to satisfaction of a sum of ₹ 50,000/-(Rupees fifty thousand) within 'two weeks'.
The petitioner shall produce a copy of the judgment along with a copy of the writ petition before the 1st respondent for further steps.
