JUDGMENT / ORDER

Petition under Section 438 Cr.P.C. 2. Petitioner is the first accused in Crime No.106/2012 of the Melattur Police Station registered for the offences punishable under Sections 324 and 307 IPC read with Section 34 IPC.
3. The allegation against the petitioner and the other accused is that on 10.03.2012 at about 10.45 pm, while the defacto complainant was standing on the road, the petitioner severely beat him with a stone covered by a cloth. When the defacto complainant fell down by sustaining serious injuries, the 2nd accused caused to run over a tipper lorry on the leg of the defacto complainant, thereby one of his legs was crushed.
4. Heard learned counsel for the petitioner and learned Public Prosecutor.

5. The learned Public Prosecutor has pointed out that initially the case was registered for the offences under Sections 279 and 338 IPC. The defacto complainant had approached this Court through a writ petition and consequently further investigation was ordered in the matter and the present offences have been incorporated. The investigation of the case is not over. The allegations against the petitioner are very grave and serious. Considering the seriousness of the allegations against the petitioner and the present stage of the investigation, I am satisfied that the petitioner is not entitled to the discretionary relief of anticipatory bail.
In the result, this bail application is dismissed.
