Despite one week's time granted to the learned Standing Counsel to seek instructions and get original service book of the petitioner from the respondent No.2, by the order dated 20.02.2018, no instructions have been received nor any statement has been made before the Court.
The petitioner is aggrieved by the order dated 29.10.2017, wherein it has been stated that he has obtained appointment on the basis of wrong date of birth and he has been suspended. The learned counsel for the petitioner has argued that the correct date of birth of the petitioner is 25.3.1968. The date of birth of the petitioner was wrongly mentioned in his service book as 25.8.1968 and it was corrected and signed by the Principal of Madarsa, way back in the year 1989.
Hence, it is provided that the disciplinary inquiry in pursuance of the suspension order dated 29.10.2017 shall be concluded within a period of six weeks and till the conclusion of the inquiry, the suspension order dated 29.10.2017 passed by the respondent No.4, Manager of Madarsa, shall remain stayed. The petitioner shall cooperate with the disciplinary inquiry.
The writ petition is finally disposed of.
