----------------------- The petitioner is the owner in possession of 97.5 cents of properties comprised in R.S.No.559/2 of Kalpakachery Village. The petitioner wants to level this land for agricultural purposes. The petitioner approached the Revenue Divisional Officer as per Ext.P2. The petitioner relies on Rule 57 (1) of Kerala Minor Mineral Concession Rules. which allows the authorities to grant permission for levellingfor domestic or agricultural purposes. Therefore, considering the nature of reasons of the petitioner, and on being with the genuineness of the claim of the petitioner, necessarily a decision shall be taken by the RDO in terms of Rule 57(1) of Kerala Minor Mineral Concession Rules. Needful shall be done within a period of four weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
