(Order on Recall Application) By the order dated 13.08.2018 non-bailable warrants has been issued against the appellants as no one had appeared on their behalf. Now on behalf of appellants an application has been filed for recalling the order dated 13.08.2018.
In the affidavit it has been stated that the appellants had engaged learned counsel Sri P.P. Srivastava on their behalf who died in the meantime and they did not receive any notice regarding his death. As such no new counsel could be engaged by them and default was committed. The cause shown is sufficient order dated 13.08.2018 is recalled. The recall application is allowed.
(Order on Appeal) Office shall issue reminder for lower court record. After receipt of lower court record office shall prepare paper book and list for hearing on its turn.
