Present Second Appeal is of the year 2005 and still pending for admission hearing. This Second Appeal is already adjourned for 46 times and mainly due to non-availability of the learned advocate appearing on behalf of the appellant.

Today also, when the present Second Appeal is called out twice, on both the occasions, learned advocate appearing on behalf of the appellant has chosen to remain absent. Hence, present Second Appeal which is of the year 2005 still pending for admission hearing, is dismissed for non-prosecution.
