Heard Sri Satya Narayan Yadav, learned counsel for the petitioner, and Sri Rohit Pandey, learned counsel for the respondents No.2 and 3.
The petitioner, claims that he was enrolled in the LL.B. IIIrd year course, in the respondent-University, in the academic year 2012-15. The petitioner has made a representation, before the respondent no. 3, to appear in the L.L.B., Vth Semester, Back Paper Examination, 2019- 20 of the subject Jurisprudence.
The only prayer made by Sri Satya Narayan Yadav, learned counsel for the petitioner, is that the said representation, may be decided within a stipulated period of time.
Sri Rohit Pandey, learned counsel for the respondents No.2 and 3, submits that the University is under obligation of law to decide all the grievance of the students, in accordance with law.
No useful purpose will be served by keeping the writ petition pending.
In the light of the submissions made by the learned counsel for the parties, the matter is remitted to the respondent No.3- Examination Controller, Chhatrapati Shahu Ji Maharaj University, Kanpur.
A writ of mandamus is issued commanding the respondent No.3- Examination Controller, Chhatrapati Shahu Ji Maharaj University, Kanpur, to decide, the representation of the petitioner, to appear in the L.L.B., Vth Semester, Back Paper Examination, 2019-20, within a period of one month, from the date of receipt, of a certified copy of this order, along with a fresh copy of the representation.
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor has judged the claim of the petitioner on merits. It is for the competent authority to do so with an independent application of mind.
With the aforesaid direction, the writ petition is finally disposed off.
