JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The matter was kept today to enable Afzalkhan Usmankhan Alias Kalukhan, respondent no.4 herein to appear before this Court. Accordingly, Afzalkhan Usmankhan Alias Kalukhan is present before the Court.
2. Wife of petitioner-Aatmaram Maganlal Patel, namely, Bhikhiben Aatmaram Patel is present before the Court. It is unfortunate that mother of the petitioner has expired yesterday. On a detailed discussion the parties have arrived at a consensus that for the present Nirali Aatmaram Patel, respondent no.12 herien will continue to pursue her studies in Nursing Course at Isanpur, Ahmedabad. During that period respondent no.4 will extend full cooperation to see that she completes her Nursing Course which is stated to be of 3½ years duration.
The petitioner assures this Court that he will not get Niraliben married without her consent. In the meantime, Niraliben will be free to visit the family of Afzalkhan at Merta City, District Nagore, Rajasthan.
3. Behrukhan, elder cousin of father of Afzalkhan is present before the Court. Mr.M.I. Shaikh, a practising advocate at Ahmedabad is also present in the Court and they assure that in the event Niraliben visits Afzalkhan's family at the aforesaid address she will be taken care and will not have any problem.
Petitioner-Aatmaram M. Patel and respondent no.4-Afzalkhan to file undertakings in the aforesaid terms. It will be appropriate at this stage that the Court puts on record its appreciation about the cooperation/ services rendered by the Police personnel of Gujarat State as well as Rajasthan State.
4. With the aforesaid order the petition is disposed of. Rule is made absolute to the aforesaid extent.
