Heard Sri Ashok Kumar Rai, learned counsel for the petitioner, Sri Vivek Shandilya, learned counsel for the respondent no.3 and the learned Standing Counsel for the respondents no. 1 and 2.
The petitioner in the writ petition is seeking a direction to the respondents to grant him benefit of second Assured Career Progression (ACP) w.e.f 1.12.2008 and also the third ACP w.e.f. 2.5.2013 with a further prayer for grant of arrears of salary w.e.f. 1.1.2016 to 30.9.2016 in pursuance of 7th Pay Commission.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with the consent of learned counsel for the parties with a direction that if the petitioner prefers a fresh representation before the respondent no.3-Executive Officer, Nagar Panchayat Moth, District Jhansi within 15 days from today along with a certified copy of this order raising all his grievances as claimed in the relief in this writ petition, the respondent no.3 shall consider and decide the same in accordance with law within a further period of three months.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
