Heard learned counsel for the petitioner and learned AGA for the State.
This writ petition has been filed by the petitioner/prosecutrix with the following prayer:
"(1) Issue a writ, order or direction in the nature of mandamus directing Superintendent of Police, Mahoba to direct the concerned police station to record the second statement of the petitioner/victim under section 164 Cr.P.C. before the concerned learned court below."
Learned AGA states that from the record, it appears that statement under section 164 Cr.P.C. has already been recorded.
In view of the above, the writ petition is dismissed as misconceived.
