In this petition for writ said to be in public interest, it is alleged that respondent Smt. Mohsina Gram Pradhan and Chairman, Land Management Committee, Gram Panchayat Nidauri, Block Razapur, Tehsil & District Ghaziabad has misused the property of Gram Sabha and as such accused loss to public interest having value of more than Rs.50 lacs.
It is stated that the respondent-Smt. Mohsina is liable to deposit a sum of Rs.50 lacs with interest at the rate of 24% per annum for the loss caused to the public/State property.
Having considered all facts of the case, we are not inclined to interfere in the matter at this stage. The petitioner is required to agitate his cause before the competent authorities of the State of Uttar Pradesh.
From perusal of the record, it also reveals that a representation was submitted by the petitioner on 11th July, 2018 to the District Magistrate, Ghaziabad without providing reasonable time to the District Magistrate to consider and decide the representation aforesaid, the petitioner preferred the instant petition for writ on 5th August, 2018.
Looking to the fact that the petitioner does not waited for appropriate time and reasonable period to get the representation submitted by him decided by the District Magistrate, we are not inclined to entertain this petition for writ at this stage. The same is dismissed. The petitioner however, is at liberty to pursue the representation submitted before the District Magistrate, Ghaziabad.
