Heard learned counsel for the applicant, learned AGA and perused the record.
By means of this application, the applicant who is involved in case crime no. 740 of 2008, under Sections 394, 302 IPC, P.S. Kanth, District- Shahjahanpur is seeking enlargement on bail during the trial.
It is contended by the learned counsel for the applicant that the applicant Aashu is not named in the FIR. On 05.02.2009, One Gautam Gupta arrested by the police and he made a confessional statement on 06.02.2009 before the police in which he stated that he along with Aashu, the applicant and some other persons had robbed Rs. 22,000/- from the deceased Sukhveer and killed him.
Keeping in view this robbery and murder of the deceased, I do not find it a fit case for bail, hence the bail application is hereby rejected at this stage.
It is expected form the learned judge that he would gear up and make all necessary endeavour to conclude the same latest by 31.012.2018, if possible. It is directed that the applicant would render all necessary co-operation in early conclusion of the trial and would not take unnecessary adjournment of the matter.
Let a copy of this order may be served by the office to the court concern within 15 days from the production of certified copy of this order.
