This Application under Section 482 Cr.P.C. has been filed with a prayer to decide the Session Trial No. 04 of 2002 in Criminal Case No. 1381 of 2011 arising out of Case Crime No. 279 of 2001 under Section 376 I.P.C., P.S. Bankata, District, Deoria pending in the court of learned Judicial Magistrate, Jevenile Justice Court No. 11, Deoria within stipulated time.
Learned counsel for the applicant has submitted that applicant in this case is father of the victim. He has drawn attention of this Court towards certified copy of the order- sheet which has been annexed by him which shows that the case was registered in year 2002 and till date not a single witness has been recorded by the trial court and frequent adjournments have been given and many dates have already been fixed for procuring the attendance of the accused as accused were abstaining from appearing before the court.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of six months from today, if there is no legal hurdle, without permitting undue adjournments to either sides.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he may approach this Court.
