A.Arumugam (Pr No.18331) vs Labour Officer (Conciliation)

Madras High Court|20 March, 2017

JUDGMENT / ORDER

The petitioner made a representation on 15.12.2016 before the first respondent seeking to conciliate the dispute raised by him with the second respondent. The said request was rejected by the second respondent on the technical premise that the petitioner was working at Pazhani Branch and therefore, the request made by the petitioner is not maintainable.
2. As rightly submitted by the learned counsel appearing for the petitioner, the order of dismissal has been passed by the second respondent alone. Thus, the said Authority has to be called for conciliation by the first respondent. If that is the case, the first respondent has certainly got jurisdiction to conciliate.
3. In view of the matter, the order impugned is hereby set aside. Consequently, the first respondent is directed to take up the request of the petitioner dated 15.12.2016 and commence the conciliation with the second respondent.
4. With the above direction, the writ petition is allowed. No costs.
