Heard Sri Brij Raj, learned counsel for the petitioner, Sri Prashant Kumar, learned counsel for respondent no.3 and learned Standing counsel for State authorities.
By means of this writ petition the petitioner has come to this Court seeking remedy that his security deposit for contractual work having been completed, be refunded.
The petitioner claims himself to be a registered Contractor. He was given five contracts for which five different security deposits were made. The petitioner completed work and given the details to the department concerned vide letter dated 07.02.2018 but his security deposits, after completion of work, has not been returned.
Learned counsel for the petitioner has not been able to show any document certifying completion of work by the petitioner. Whether petitioner actually completed the work or not is for the authority concerned to look into and in case the petitioner has completed his work as per the contract, he is entitled to get his security deposits refunded. In this regard, the petitioner has already made a representation to respondent no.3 which is still pending.
The writ petition is disposed of with the direction to respondent no.3 that in case the petitioner's work is complete and is satisfactory, there are no dues pending against the petitioner and there is no other legal impediment, his security deposit be refunded in accordance with law, as far as possible within three months from the date of presentation of a certified copy of this order before him.
