Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 170 of 2019, under Sections 354(Kha), 376, 511 IPC and Section 5/6 POCSO Act, P.S. Sarpataha, District Jaunpur, is seeking enlargement on bail during the trial.
I have perused the statement under Sections 161 and 164 Cr.P.C of the girl and the applicant shamelessly un-robed the minor girl of 10 years but on account of providence her mother came on sight. The applicant is close relatives of small girl who mercilessly tried to outrage the modesty of a girl.
Taking into account the age of the girl is of 10 years and she has attempted to ravished her, which itself abhorring and allegation of attempt to rape upon her.
I am not inclined to exercise my discretion in favour of the applicant, the bail application is hereby rejected.
