Heard learned counsel for the petitioner, learned AGA for respondent nos. 1 to 3 and Sri A.K. Mishra, Advocate holding brief of Sri Mahendra Singh, learned counsel appearing for the respondent nos. 4 to 7 and perused the record.
In compliance of the order dated 12.10.2018, corpus Smt. Aalam Ara (petitioner no. 1) has been produced before this Court today by her brother (respondent no.4) and has been duly identified by Sri A.K. Mishra, learned counsel appearing for the respondent nos. 4 to 7. There is no dispute with regard to the age of majority of corpus.
On query being raised by this Court, the corpus Smt. Aalam Ara (petitioner no. 1) refused to go with petitioner No. 2, Imtiyaz and she stated that she wants to go with her brother, Munna @ Rahmatulla (respondent No. 4). The statement of the corpus has been recorded separately in the order sheet of this case.
In view of the above, the Corpus Smt. Aalam Ara (petitioner no. 1) is major and she refused to go with her petitioner No. 2, Imtiyaz, therefore, this Court could not compel the corpus to go with petitioner No. 2, Imtiyaz against her wishes. Hence, she is at liberty to go wherever she likes.
Accordingly, the writ petition is dismissed. Order Date :- 26.10.2018 Sartaj
