JUDGMENT / ORDER

This application has been preferred by the applicant (original respondent No.2) with a prayer to fix an early date of hearing for Special Civil Application No.13703 of 2009.
Heard Mr.K.K.Trivedi, learned advocate for the applicant and Mr.Pranav Dave, learned Assistant Government Pleader for opponent No.1 (original petitioner), and perused the averments made in the application.
It is submitted by Mr.Trivedi that the applicant is a bona fide purchaser of the land which is the subject-matter of the petition. The order dated 27.09.2007, whereby the Gujarat Revenue Tribunal has directed the applicant to make an application to the Collector to pay the premium, has been challenged by the State Government. It is submitted that the applicant wants to develop the land and has no objection to payment of premium. However, due to the pendency of the petition and the stay granted in favour of the State, the applicant has moved the present application, as ultimately, the applicant would be burdened with a heavy amount of premium as the final decision of the petition may take a long time.
Having heard the learned counsel for the respective parties, the following order is passed:-
The application is allowed. Registry shall fix Special Civil Application No.13703 of 2009 for final hearing on 20.03.2012.
