For Petitioners : Mr.V.Purushothaman For R1 : Mr.C.Emalias, Addl. Public Prosecutor For R2 : Mr.T.K.Rajesh ORDER The present criminal original petition has been filed to call for the records in P.R.C.No.40 of 2016 on the file of the learned Judicial Magistrate at Alandur and quash the same.
2. Today, the petitioners and the second respondent/ defacto complainant along with their respective learned counsel on record are present. Learned Additional Public Prosecutor for the first respondent is also present. The identities of the parties have been verified. They have submitted that the dispute between them has been amicably settled. They have also filed a joint compromise memo dated 28.02.2017 signed by all the parties to that effect. When this Court enquired the parties, particularly, second respondent / defacto complainant, about the factum of compromise and the terms of the compromise, he admitted the same. He also expressed no objection in quashing the criminal proceedings in Cr.No.1777 of 2014, which culminated as PRC No.40 of 2016, on the file of the learned Judicial Magistrate, Alandur.
3. In view of the above, this Criminal Original Petition is allowed and the criminal proceedings in Cr.No.1777 of 2014, which culminated as PRC No.40 of 2016, on the file of the learned Judicial Magistrate, Alandur is quashed. The Joint Compromise Memo dated 28.02.2017 signed by all the parties is taken on record. Consequently, connected Miscellaneous Petition is closed.
