JUDGMENT / ORDER

1. Heard learned advocate Mr. Raval appearing for the petitioner and learned advocate Mr.Kishore Prajapati for learned advocate Mr. Mehul H. Rathod for respondent Board.
2. In present petition, the petitioner has challenged the legality and propriety of the order dated 19/03/2012.
3. Today, during the hearing, learned advocate Mr.Prajapati for Mr. Rathod has placed on record a communication dated 05/05/2012 addressed by the Chief Administrative Officer of the respondent Board. The said communication is addressed to learned advocate Mr.Rathod. The respondent board has stated inter alia that considering the opinion from learned advocate, the respondent board has decided to pass fresh order after hearing the petitioner after withdrawing the order in question.
4. Learned advocate appearing for the respondent board has, on the strength of communication dated 05/05/2012, submitted that respondent board shall withdraw the order impugned in present petition and shall pass fresh order after giving opportunity of hearing to the petitioner.
5. Learned advocate for the petitioner, in view of said statement made by learned advocate for the respondent board and in light of communication dated 05/05/2012, submitted that the petition may be disposed of at this stage in light of said statement and communication. Since the petitioner will be allowed opportunity of hearing and that the petitioner does not press the petition at this stage in view of the statement made by learned advocate for the respondent board and in view of communication dated 05/05/2012.
6. The petition stands disposed of accordingly as not pressed at this stage.
