PRAYER: Contempt Petition filed under Section 11 of Contempt of Courts Act, 1971, to punish the respondent for wilfully disobeying the order dated 10.09.2015 in W.P.No.28533 of 2015 passed by this Court.

This Court, by order dated 10 September 2015 in W.P.No.28533 of 2015 directed the Revenue Divisional Officer, Salem to consider the claim made by the petitioner for issuing Community Certificate to his son indicating that he belongs to Kurumans Community, which is a notified Scheduled Tribe http://www.judis.nic.inCommunity.
2. Since the respondent failed to pass orders in spite of the time prescribed by this Court, the petitioner has come up with this contempt petition.
3. During the currency of this contempt petition, the respondent passed an order rejecting the request made by the petitioner for issuing community certificate.
4. This matter was argued at length on 27 June 2017, in view of the contention taken by the petitioner that the respondent while rejecting the request for community certificate failed to take into account the direction given by this Court in paragraph 6 of the order. In view of the said contention, the learned Special Government Pleader took time to take instructions as to whether it is possible to recall the order passed by the Revenue Divisional Officer, Salem with liberty to conduct fresh enquiry and pass orders on merits.
5. When the Contempt Petition was taken up for consideration today [28 June 2017], the learned Special Government Pleader produced a copy of the order dated 27 June 2017 indicating that the respondent has recalled the earlier order dated 14 April 2017 and agreed to conduct enquiry and pass fresh orders on merits.
6. We direct the Revenue Divisional Officer, Salem to conduct enquiry in the matter and pass orders on merits and as per law. Such exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
The contempt petition is closed with the above direction.
