HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.37542 of 2014 ORDER:
According to the petitioner his father A. Venkaiah, expired on 18.11.2012. During the life time of his father he has opened fixed deposit account for an amount of Rs.3 Lakhs in the Andhra Bank, Ramanthapur Branch, Hyderabad. The fixed deposit was matured on 19.07.2012. His late father has also opened a savings Bank Account No.048510011009928 in his name and his wife. After the demise of his father, the account was transferred in the name of the petitioner as his name was mentioned as nominee to the aforesaid account. In so far as the fixed deposit account is concerned, as no particulars are forthcoming and as the petitioner is not aware as to whether any nomination was given by his father when he opened the fixed deposit account, the petitioner solicited information regarding the details of nomination. A representation to this extent was submitted on 06.08.2014. But so far no such information is furnished. Having waited for considerable time, the petitioner instituted this writ petition complaining that for no justifiable reason, the information sought by the petitioner was not furnished and as a consequence, the fixed deposit even though had matured is lying with the respondent-Bank.
2. The matter underwent adjournment to enable the Standing Counsel to obtain instructions. Learned Standing Counsel is unable to place the instructions as to why the information as sought by the petitioner was not furnished.
3. Having regard to the above, without expressing any opinion on merits, this writ petition is disposed of directing the Branch Manager, Andhra Bank, Ramanthapur Branch, Hyderabad (2nd respondent) to furnish the information as sought by the petitioner in his representation dated 06.08.2014 within a period of two weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
