The applicant has preferred the present contempt application for non-compliance of the final judgment and order dated 20.03.2014 passed by Debt Recovery Tribunal in Securitization Application No. 206 of 2012 (M/S A.V.S. Rotopack Private Limited v. Senior Branch Manager, Bank of India & 3 others) as well as order dated 02.07.2019 passed by the Debt Recovery Appellate Tribunal in Appeal No. R-48 of 2014 (Senior Branch Manager, Bank of India & 2 others v. M/S A.V.S. Rotopack Private Limited & another).
A supplementary affidavit has been filed by the opposite party - bank. In paragraph 3 of the supplementary affidavit, it is stated that against the aforesaid orders of the Debt Recovery Tribunal, the opposite party - bank has filed Civil Misc. Writ Petition being Writ - C No. 20307 of 2021 before this Court. This Court vide order dated 25.8.2021 has stayed both the orders of the Debt Recovery Tribunal.
In this view of the matter, the Court is of the opinion that no further orders are required to be passed in the present Contempt Petition.
The contempt application is dismissed.
