ORDER:
In this writ petition, the grievance of the petitioner, who is having outsourcing contract for supplying manpower for operation and maintenance works of equipments of Stage-III of Rayalaseema Thermal Power Project, is that respondent No.1 has not been considering its request for substitution of skilled and semi-skilled labour in place of the discontinued labour.
At the hearing, Mr. M. Vidyasagar, learned counsel for the petitioner, has not disputed that though his client has made oral request for permitting it to substitute the skilled and semi-skilled discontinued workers with other skilled and semi-skilled labour, no written representation has been made. Therefore, the petitioner is permitted to make a written representation to respondent No.1 for substitution of skilled and semi-skilled personnel. Within one week from the date of receipt of such representation, respondent No.1 shall consider the same in accordance with the agreement and also the previous practice, if any, take a decision and communicate the same to the petitioner.
Subject to the above observation and direction, the writ petition is disposed of.
As a sequel to the disposal of the writ petition, W.P.M.P.No.40163 of 2014 shall stand disposed of as infructuous.
