ORDER:
This writ petition is filed for a mandamus to direct respondent Nos.2 and 3 to issue/supply essential commodities to the petitioner’s fair price shop for distribution to the cardholders.
On finding that the petitioner has obtained demand draft as far back as 16.10.2014 towards the value of the essential commodities and that respondent No.3 has not received the demand draft and released the essential commodities, this Court has summoned respondent No.3.
Accordingly, respondent No.3 is personally present. He has stated that on receiving demand draft on 24.10.2014, he has released the essential commodities to the petitioner.
Though this Court is convinced that for extraneous reasons, respondent No.3 has not received the demand draft from the petitioner, treating his act as first lapse, this Court refrains from proceeding further with the caution to respondent No.3 not to repeat such acts in future.
Inasmuch as the petitioner’s grievance stood redressed with the release of the essential commodities, the writ petition is closed.
As a sequel to disposal of the writ petition, W.P.M.P.No.39687 of 2014 shall stand disposed of as infructuous.
