JUDGMENT / ORDER

THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.15351 0f 2008 Between:
A. Udya Rajulu PETITIONER AND
1. The District Collector, Kadapa District, Kadapa, and others.
RESPONDENTS ORDER:
This writ petition, filed under Article 226 of the Constitution of India, challenges the proceedings Roc. No.2027/2006-A4, dated 15.05.2008, issued by the District collector, Kadapa District, the 1st respondent herein, according permission in favour of the 4th respondent for construction of Dhyana Mandiram in Sy.No.633 Plot No.18 Rjampet Town.
2. This Court while issuing Rule Nisi on 17.07.2008 passed the following order:
“Having regard to the fact that the 4th respondent has already commenced the construction, it is made clear that the further construction, if any, made shall be subject to further orders of this Court and the 4th respondent shall not claim equities on any ground whatsoever.
Sri S.I. Newton, who accepted notice for the 3rd respondent, undertakes to produce the record and file counter in 10 days.
Post on 28.07.2008”
6. Today, when the matter is taken up, it is represented by the learned counsel appearing for the 4th respondent that the 4th respondent had already sold out the subject property in favour of the third party and no Dhyana Mandiram was built up, but a residential house has been constructed in the subject land. In view of the above developments, nothing survives in the writ petition for adjudication.
7. For the foregoing reasons, the writ petition is closed. No order as to costs. As a sequel, miscellaneous petitions, if any shall stand closed.
