HON’BLE SRI JUSTICE S. RAVI KUMAR CRIMINAL PETITION No. 9211 of 2012 ORDER:
This petition is filed to quash FIR in Crime No.206 of 2012 of Kakatiya University Campus Police Station, Warangal Urban, for alleged offences under Sections 447 & 427 of IPC.
2. Heard both sides.
3. Advocate for petitioners submitted that there is a civil dispute between the parties and a suit is also pending in respect of same property in O.S.No.1440 of 2010 on the file of II Additional Junior Civil Judge, Warangal and the civil dispute is converted into a criminal dispute. He further submitted that the petitioners have purchased the property through registered sale deed dated 11.02.2010.
4. Learned counsel for respondent submitted that those are specific allegations against petitioner and the matter requires investigation.
5. Considering the submissions of both sides, this petition is disposed of directing the police to expedite the investigation and file final report as early as possible since both offences alleged are bailable in nature. The police have to follow Section 41 and 41(a) of Criminal Procedure Code.
6. Accordingly, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions, if any filed in this criminal petition, shall stand closed.
