ORDER:
This Writ Petition is filed for a Mandamus to declare the action of respondent Nos.4 to 6, in not considering the petitioner’s representations, dated 16.07.2014 and 06.10.2014, as illegal and arbitrary.
The petitioner averred that he has hired two buses bearing registration Nos.AP.35 U.8513 and AP.35 U.8514 to respondent No.6 and five buses bearing registration Nos.AP 35 U.8599, AP 35 U.8699, AP.35 U.8799, AP.31 TU.2248 and AP.31 TU.2258 to respondent No.5. He has further averred that while the two buses hired to respondent No.6 are being run for 19 kms extra distance each day, the five buses hired to respondent No.5 are being run for 25 kms extra distance each day. He further pleaded that in respect of bus bearing registration No.AP.35 T.8599, which was purchased by the petitioner from its previous owner and lessor of respondent No.1, viz., D.Subba Rao, the previous owner had incurred a liability of Rs.25,000/-, but the same was deducted from the bills payable to the petitioner. The petitioner is stated to have submitted representations, dated 16.07.2014 and 06.10.2014 to respondent No.4 besides causing issue of legal notices to respondent Nos.5 and 6 on 07.06.2014. The grievance of the petitioner is that none of the respondents have been redressing his grievance.
After hearing Sri E.Maruthi Raja, learned counsel for the petitioner and Sri S.V.Ramana, learned Standing Counsel for APSRTC (Andhra region), this Writ Petition is disposed of with the direction to respondent No.4 to consider the petitioner’s representations, dated 16.07.2014 and 06.10.2014, take an appropriate decision with reference to the lease agreement and communicate the same to the petitioner within one month from the date of receipt of a copy of this order.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.48514 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
