2. Heard the learned counsel for the petitioner and the learned Special Public Prosecutor (CBI Cases) appearing for the respondent.
3. It is submitted by the learned counsel for the petitioner that the petitioner's Indian bank account No.709193407 was freezed by the CBI under the guise that the said account was operated by A.2 in the case who is none else the brother of the petitioner.
4. The learned Special Public Prosecutor (CBI cases), submitted that during enquiry, it came to light that the said bank account of the petitioner herein has got nothing to do with the present case. The said statement is recorded. Further, the learned Special Public Prosecutor submitted no objection for de-freezing the said bank account of the petitioner.
5. In view of the said submissions made by the learned Special Public Prosecutor (CBI cases), this Court directs the learned II Additional District & Sessions Judge/Special Judge for CBI Cases, Coimbatore, to take the said Un numbered Crl.M.P.No of 2016 in C.C.No.2 of 2010 on his file and allow the said miscellaneous petition.
6. With the above direction, the Criminal Original Petition is allowed.
