Athinarayanan Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying to issue a WRIT OF HABEAS CORPUS or any other order or direction in the nature of writ directing the respondents to produce the body of the Detenues namely Minor.Manisha D/o Athinarayanan, aged about 8 years and Minor.Srisivaram, S/o Athinarayanan, aged about 5 years before this Court and handed over to the custody of the petitioner and pass such further or other orders and thus render justice.
[Order of the Court was made by S.NAGAMUTHU.J] The petitioner is the wife of the 3rd respondent. They have got two children viz., Minor.Manisha, aged about 8 years and Minor.Srisivaram, aged about 5 years. Now, the children are in the custody of the 3rd respondent. With that allegation, the petitioner has come up with this Habeas Corpus Petition.
2. In our considered view, it is not an illegal detention. If the petitioner claims, that she has got the right to take the children, she can work out her remedy before the appropriate forum. Therefore, we are unable to grant any relief sought by the petitioner. Hence the Habeas Corpus petition is dismissed.
