Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the respondent police to conduct a fair and effective investigation in Crime No.737 of 2014 pending on his file and file the final report before the appropriate court within the time frame fixed by this Court.
2. It is the case of the petitioner that he is the Manager of M/s.Anand Parking Yard, which is a professional parking yard, rented out for the finance companies for parking the re-possessed vehicles. On 2.4.2014 at about 9.30 p.m., some unknown persons came to the parking yard and forcibly entered into the parking yard and had towed away one Toyota Innova Car. Immediately, he lodged a complaint with the respondent police, but, the respondent police refused to register the same. Hence, the petitioner filed a petition before this Court in Crl.O.P.No.9821 of 2014 seeking a direction to the respondent police to register the complaint and this Court, by order dated 16.6.2014, directed the respondent police to register a case based on the complaint of the petitioner. Pursuant to the said order, the respondent police registered a case in Crime No.737 of 2014. Though the said complaint was registered as early as in the year 2014, till date, final report was not filed. Hence, the present petition.
3. I have heard the learned Additional Public Prosecutor.
4. Considering the facts and circumstances of the case, this Court directs the respondent to investigate the case in Crime No.737 of 2014 pending on his file and file a final report, if not already filed, as expeditiously as possible, preferably, within a period of six weeks from the date of receipt of a copy of this order. The Criminal Original Petition is ordered accordingly.
