2. Today, when the matter came up for hearing, learned Additional Public Prosecutor submitted that the case in Crime No.211 of 2016, after completion of investigation, was referred as “Mistake of Fact” vide RCS No.2/2017 dated 20.01.2017. The said submission was denied by the learned counsel for the petitioner.
3. This Court is of the view that since the matter has already been closed as mistake of fact, it is unnecessary to pursue this petition. However, it is open to the petitioner to file appropriate petition before the Court concerned, in the manner known to law.
4. With the above observation, this Criminal Original Petition is closed.
