ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for respondents 1 and 2.
This Writ Petition was filed challenging action of the respondents 1 and 2 in harassing the petitioner by interfering with the civil disputes between the petitioner and third respondent and in the process forcing him to visit the police station.
This Court by order dated 3.11.2008 directed respondents 1 and 2 not to interfere with the civil disputes pending between the petitioner and the third respondent without following the due process of law.
Respondents 1 and 2 filed a counter affidavit stating that the third respondent did not approach them and did not lodge any complaint against the petitioner and therefore they never summoned the petitioner nor made him to sit in the police station up to evening. In the absence of any complaint against the petitioner, the question of calling him to the police station does not arise. It appears that there are disputes between the petitioner and the third respondent which are no way concerned with them. Respondents 1 and 2 denied other allegations of the petitioner.
In view of the categorical averments made by respondents 1and 2 in the counter affidavit, this Writ Petition is misconceived and is accordingly dismissed. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
