Heard Sri V.C. Tiwari, learned Counsel for the appellant and Sri B.P. Singh Kachhawah, learned Standing Counsel for the respondents-State.
The instructions have come in this matter. It appears that the appellant, whose suspension was stayed by the learned Single Judge is seeking to be posted on the same post, which he was holding before the order of suspension was passed. However, the charge has been given to another officer and the appellant has been attached as Joint Director in Bareilly, which is a position at par as the position he was holding previously.
Learned Single Judge has also passed an order saying that the departmental proceedings may be concluded within a period of three months. The period of three months is over.
We give the respondents one month's further and no more time from today to conclude the disciplinary proceedings. Needless to say the appellant will have to co-operate. He will not ask for any frivolous adjournment. Neither the respondents shall take any frivolous adjournment. The inquiry proceedings to commence immediately and to be concluded by 19th January, 2019.
It is made clear that the appellant as a disciplined officer of the State will join the post where he has been attached.
With the aforesaid observations the Special Appeal stands disposed of. No costs.
A copy of this order may be given to Sri B.P.Singh Kachhawah, learned Standing Counsel within 24 hours for necessary compliance and communication.
