THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Mr.P.N.Harish, learned counsel for the petitioner. Mr.Vijay Kumar A.Patil, learned Additional Government Advocate for respondents.
2. The writ petition is admitted for hearing.
With consent of the learned counsel for the parties, the same is heard finally.
3. In this petition, the petitioner inter alia seeks a direction to respondent No.2 to decide the appeal No.2/13 pending before it expeditiously in accordance with law.
4. When the matter was taken up today, learned Additional Government Advocate submitted that in case the appeal is still pending before respondent No.2, the same shall be decided in accordance with law within such time limit as may be fixed by this Court.
5. In view of the aforesaid submission, the petition is disposed of with a direction to respondent No.2 to consider and decide the appeal preferred by the petitioner if not already decided by a speaking order and after affording an opportunity of hearing to the necessary parties within a period of four months from the date of receipt of certified copy of the order passed today. It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the petition is disposed of.
