JUDGMENT / ORDER

Petitioners apprehend arrest in C.C. No.759 of 2013 of the Judicial First Class Magistrate, Varkala. 2. I have heard the learned counsel for the petitioner and the learned Public Prosecutor.
3. The case was taken on file on the strength of a private complaint. The SHO, Varkala has, in his report dated 05.05.204 informed that the petitioners are issued with summons from the Judicial First Class Magistrate's Court, Varkala for their appearance in that Court on 25.06.2014.
4. In the light of the above and the legal position as to the procedure to be followed when the accused appears in court pursuant to summons there is no necessity to proceed with this application.
The application is closed without prejudice to the petitioners seeking appropriate relief in the court of learned Judicial First Class Magistrate, Varkala on their appearance in that court in pursuance to the summons served on them.
