For Petitioner : Mr.Auxilia Peter For Respondent : Mrs.Sudha Ramalingam ORDER The present criminal original petition has been filed seeking a direction to the First Additional Family Court, Chennai to dispose of the case in M.C.No.90 of 2012 within a time frame fixed by this Court.
2. Learned counsel for the petitioner submitted that the petitioner filed a maintenance case in M.C.No.90 of 2012 on the file of the I Additional Family Court, Chennai, which is pending without any progress. Hence, this Criminal Original Petition.
3. Learned counsel for the respondent has no objection in directing the lower court for early disposal of the maintenance case. A counter affidavit has also been filed by the respondent to that effect, wherein, it has been specifically stated as follows:
“For the reasons stated above, I pray that this Hon'ble Court may be pleased to direct the I Additional Family Court to dispose M.C.No.90 of 2012 in a time bound manner and render justice.”
4. In view of the submissions made by the learned counsel on either side and taking note of the no objection expressed by the respondent herein, this Court directs the I Additional Family Court, Chennai to dispose of the case in M.C.No.90 of 2012 pending on its file, on merits and in accordance with law, as expeditiously as possible, preferably, within a period of four months from the date of receipt of a copy of this order.
5. With the above direction, the Criminal Original Petition is disposed of.
