On 5.8.2021, we had passed the order requiring the petitioner to file a supplementary affidavit undertaking his willingness with regard to the payment of entire defaulted amount.
Today, Shri Ashok Kumar Upadhyay, learned counsel for the petitioner states that the petitioner is not in a position to give such an undertaking.
As such, learned counsel for the petitioner prays to withdraw this petition with liberty to approach to the respondent-Bank under One Time Settlement Scheme.
Accordingly, the writ petition is dismissed as withdrawn with liberty, as prayed for.
