This Criminal Petition is filed under section 482 Cr.P.C. to quash FIR in Crime No.80 of 2004 on the file of Mulkanur Police Station, Karimnagar district.
2. This Court ordered notice before admission and petitioner counsel was permitted to take out personal notice to second respondent by registered post with acknowledgement and to file proof of service but no proof of service is filed and no one appeared on behalf of petitioner.
3. Learned Public Prosecutor submitted that Police have filed final report on 21/5/2012 referring the case as “false”. He produced a copy of the final report dated 21/5/2012 signed by Sub-Divisional Police Officer, Huzurabad, according to which after obtaining opinion from the Legal Adviser the case is referred as “false” and requested the court below to issue proceedings accordingly.
4. Since the final report is filed referred the case as “false”, this Criminal Petition is liable to be dismissed as infructuous.
5. For the above reasons, this Criminal Petition is dismissed as infructuous.
