ORDER:
The petitioner is an ex-serviceman. He was assigned Ac.0.03 cents of land in Plot No.1 in Survey No.129/2-A, situated at Kurugunta Village, Anantapuram Mandal, Anantapuram District, as an ex-serviceman, through proceedings in HS.Dis.No.3/1402, dated 13.08.1992, by the then Tahsildar. With an intention to dispose of the said property, when the petitioner approached the Sub-Registrar, Anantapuram Urban, Anantapuram District (4th respondent), for presentation of the document, the 4th respondent insisted for obtaining No Objection Certificate from the District Collector. Aggrieved thereby, this writ petition is instituted.
2. As per the orders in G.O.Ms.No.307, Revenue (Assignments.I) Department, dated 06.06.2013, the District Collector, Visakhapatnam (3rd respondent) has to grant No Objection Certificate to the lands assigned to ex-servicemen.
3. At this stage, learned counsel for the petitioner submits that the petitioner would be advised to submit an application before the District Collector, Anantapuram, Anantapuram District (2nd respondent) for issuance of No Objection Certificate and the same may be processed within a time bound period.
4. Having regard to the submissions made, this Writ Petition is disposed of giving liberty to the petitioner to submit a representation to the District Collector, Anantapuram, Anantapuram District (2nd respondent), requesting for issuance of No Objection Certificate on the land assigned to him and as and when such a request is received, the District Collector shall consider and pass appropriate orders, as warranted by law, within a period of three (3) weeks from the date of receipt of such application. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
